irony, it turns out that teachers in california are investors in bushmaster. california state teachers retirement system invested $600 million in cerberus, that private equity firm. that means the teachers retirement fund owns 2.4% of the freedom group, parent of bushmaster. it is now reviewing that investment and other potential holdings in gun companies. chief investment officer at the teachers retirement system. thank you so much for talking with us and walking us through this this morning. clearly you must have heard from teachers over the past week. >> yes, we have, through e-mail, phone calls and social media. >> what are they telling you? >> well, obviously, they're very distraught, as we were. and, you know, i was devastated when we realized we had this investment in our portfolio. it's extremely small. that's why we hadn't focused in on it, in particular. and their reaction, obviously, is of great concern. >> i should point out there are a lot of retired california teachers. you are one of the biggest sort of investors in the country. you have a very big, broad portfolio. teac

hospital. how she's doing and when she might go home when we continue. >>> in california, a law that mainstream mental health groups and equal rights advocates have held as a milestone is under attack tonight. the law bans so-called conversion therapy or reparative therapy, a so-called treatment that claims to turn gay children and teenagers straight. california's ban was scheduled to take effect january 1st but in the last 48 hours, two federal judges have issued opposing rulings in separate lawsuits challenging the ban. one judge ruled that three plaintiffs will be able to continue offering the therapy until their trial is over. the other judge denied an injunction to a separate set of plaintiffs. both lawsuits, it's confusing, but both lawsuits claim that banning the so-called therapy violates therapists' first amendment rights. keep in mind, nearly all mainstream medical and psychological associations say there's no solid evidence that any of these therapies work, while they also say they may be damaging. we're talking about kids, teenagers who often don't choose this therapy for

to california's proposition 8 which took away the right for gays and lesbians to legally wed in the state. now the court's expected to hear arguments in march, with a ruling by late june. and the decision to take on the issue comes just weeks after voters in three more states approved same of sex marriage. joining me now, cnn's legal analyst jeffrey toobin. how big is this? put this in perspective. >> huge. this is really a major event in american history, not just court history. same-sex marriage now is at the center of the american legal world. this was a cause that was seen as a fringe issue as recently as the '90s. >> it wasn't even mentioned as a possibility. >> it was not even mentioned. polling has gone from, you know, approximately 20% to 30% support in the '90s. now gallup poll showed 53%. exist polls showed 49%. now ark fears command close to a majority support. and now the supreme court may decide that same-sex marriage will be the law of the land everywhere. >> how much of this has been affected by the fact that for the first time in this last election you have people go

being reported across southern california. also thunderstorms being reported yesterday in las vegas. that was the 25th day they saw thunderstorms this year. the record is 26. so a lot of thunderstorms in vegas. you had record rainfall of a quarter inch in san diego. you had 1.56 inches of rainfall. yuma, you had record rain as well. the rain in through phoenix. it is snowing through flagstaff, getting into the grand canyon as well. this system will slowly spiral its way into the four corners and bring with it more in the way of some heavy snow. some of it will be over the san juans of southwest colorado. they'll take that fresh powder, for sure. the south side of the system will have wind as well with winds gusting to 60 miles an hour. ahead of that, warm and sunny. a nice chill in the air to get you in the mood for the season across the east coast. that's a quick check on weather. . but now the california teachers retirement system is a big investor in that fund and making them an indirect investor in the maker of bushmaster rifles. you can imagine there is a bit of an issue here. i want to go to don primac of fortune. he broke this story. dan, how did this -- the california teachers union become involved in this sort of investment thing with a company that makes bushmaster rifle? >> the california teachers pension, the largest pension for public school teachers in america, it invests a lot in private equity funds that do everything from health care to retail to manufacturing. serbrus is a diversified funds. those funds invested in freedom group or created freedom group, they bought bushmaster and started adding on, adding on to make what is currently the largest u.s. gun manufacturer. >> so, dan, is this like when you invest in your 401(k) or whatever, whatever investment you might have, and it is in a mutual fund and you don't know which companies are in that mutual fund. is that how it is or did they have direct knowledge that this company was a maker of the

for the verdict because it doesn't just affect california, but have a huge impact that the precedent is trying to legalize marijuana much like washington state did just last month. medicinal marijuana is legally in california, but the feds are trying to force these landlords to evict dispensaries such as this health center in oakland which the government said is at the center of the case because they said selling marijuana is illegal. on the case with me today, sunny, we know a judge ruled that the oakland shop could say open because it was not violating state law, but we are talking federal governments. >> that's the real issue. there is a tension that exists when it comes to marijuana. medical marijuana and recreational use of marijuana. that's because under the federal laws, it's illegal to smoke and possess it and sell it. the voters have spoken in colorado and washington saying recreational use of marijuana is okay. in 1996 in california, they okayed the voters did, the use of medical marijuana. you have this tension. earlier this year, president obama speaking to barbara walter
